BOUNDARY DISPUTE RESOLUTION

Cutting down hedges, planting trees and moving fences often give rise to boundary disputes which are the most common differences that occur between neighbours – although most of the time these can be resolved quickly and in a friendly manner.

Either party to the dispute can appoint us, either through the Courts or in their own right, to determine the exact position of the boundary. This is the best and most economical route. Each party can appoint their own surveyor and the two surveyors will then analyse and determine where the boundary should be and negotiate a settlement based on that analysis. Occasionally, in the event that they are unable to agree, then a third surveyor is appointed who will make the final decision.

BUILDING SURVEYS

Not only is a SURVEY one of your most valuable investments ESSENTIAL before purchase, but the QUALITY of the survey and the surveyor are important.

All our surveys are explicit and state what is wrong with the property, how to put it right and the likely cost of the repairs and remedial works – using a mini camera we were able to discover unseen rot and defects beneath the floor of a listed building in Hampton Court!

Which survey should I choose?

Homebuyers’ Survey & Valuation – this report is in a standard RICS format and will cover the general condition of the property taking account of its age, character and location; and any defects or other matters requiring attention, together with a market valuation.

Full Structural Survey (now a Building Survey or a Headline Survey) – recommended particularly for older properties, listed buildings and properties that have been constructed in an unusual way or have had extensive alterations. A structural survey will include recommendations for further inspections and advice on costs of repairs which, if necessary, may be used by the purchaser to renegotiate the purchase price – so, a very worthwhile investment!

Specific Defects Survey – the purpose of this survey is to investigate and analyse specific defects prior to recommending remedial measures. Specific defects include elements such as cracking, ceiling and floor deflection, undulating roofs and distorted structures.  Tudors specialises in historic and listed buildings, and our extensive experience and expertise in these matters enables us to deliver optimum property solutions.

DILAPIDATIONS

A Schedule of Dilapidations is a written document, usually prepared by the Landlord’s surveyor, which details breaches of the lease and requires the tenant to carry out repairs, redecoration and in some cases remove alterations. It may be served during or after a lease has finished, be it commercial or residential.

Tudors will serve Notice on the tenants for you requiring them to put the property into good tenantable order prior to leaving the premises, regardless of whether it was the landlord or tenant who gave Notice. The document has a protocol format which, when properly prepared, can be used in Court for any proceedings.

HISTORIC AND LISTED BUILDINGS

A listed building is one included on the List of Buildings of Special Architectural or Historic Interest.

There are various scales to the listing and different rules for repair and alteration for each category:

Grade I - major historic site
Grade II* - minor historic site
Grade II - over 200 years old - special features which are specifically listed
Grade III - some historic interest
Local Conservation Listing - building shown on local Council plan as having some historic merit to the area.

Before purchasing a listed building, a survey should be carried out by a surveyor with proven expertise in historic buildings. The various forms of construction used to span the centuries needs to be fully understood by the surveyor. This is a specialist service offered by Tudors based upon 40 years experience.

The survey may reveal a number of building defects, and it is important to obtain professional advice on those of major concern which will require immediate and perhaps costly attention.

Probably the most important advice before purchasing a listed building is to make sure that it is suitable for your requirements. Only alterations and extensions which respect the character (external and internal) will be granted Listed Building Consent by the Local Planning Authority.

PARTY WALL AWARDS

We can assist in the structural aspects of Party Wall Awards, and can act as Party Wall Surveyors as required by the Party Wall etc. Act 1996.

We can also advise clients directly e.g. if a neighbour is proposing to carry out any underpinning, loft conversion or new extension works on or adjacent to the Party Wall, or within 3 metres of the Party Wall if the new foundations are deeper than those of the party wall.

Your neighbour must serve a Notice of their proposals and allow you to employ, at their cost, your own Engineer/Surveyor to ensure your rights are not overridden or infringed upon. This is the law.

The basis of the Party Wall Award is to set out the conditions for the running of the building works, insofar as they relate to the Party Wall, so that they do not unnecessarily interfere with your occupation of your building, together with a written description of the condition of the wall or building in question and photographic evidence. The Award is a legal document and the written report is set aside until completion of construction works when it is used as a reference to ensure no damage has been incurred.

PROBATE VALUATIONS

When someone dies, their estate needs to be valued and any tax paid before the Will can be executed – and, very often, property forms the greatest asset(s) of an estate.
